The homeowner of 74 Livingstone Walk, Hemel Hempstead, HP2 6AL, a former council property, is now seeking to sell it back to Dacorum Borough Council.
After conducting a thorough review and evaluation, it is recommended that the Council makes a formal offer to purchase the property.
74 Livingstone Walk fits the Councils criteria for acquisition, and supports the outcome of the Housing Estate Review.

03/03/2025 - Supplementary Technical Instructions ref: 2385    Recommendations Approved

The implementation of the Procurement Act 2023 requires the Council to update is governance arrangements in relation to commissioning, procurement and contract management.
The Council has updated and simplified the Commissioning & Procurement Standing Orders, and these were approved by Council in February 2025.
The Supplementary Technical Instructions is an additional guidance document that has been developed. This document provides officers with clear advice and guidance on how to comply with the the Council's own governance arrangements and national legislation when undertaking commissioning and procurement activities.
The document also refers to a range of commissioning and procurement guidance and templates that are available for officers to download from the Procurement SharePoint Hub.
The guidance and templates will ensure compliance, risk mitigation and a commercial approach to all third party expenditure.

12/03/2025 - 31Ten Extension of Contract ref: 2389    Recommendations Approved

The Council has been working with 31Ten as part of MHCLGs PropTech programme.
The Council has received grant funding as part of the new round of PropTech, and it is therefore recommended that the appointment of 31Ten be extended.
Extending the appointment of 31Ten will allow us to further develop the viability tool in support of the Strategic Asset Review (SAR), the Investment Partnership (IP), and replace the Housing Development Teams existing viability tool.

11/03/2025 - PH-006-25 To introduce a Traffic Regulation Order to enable parking enforcement of Electric Vehicle Charge Point (EVCP) bays in neighbourhood shopping centre locations ref: 2388    Recommendations Approved

Decision:

 

·       To continue to make and implement the Traffic Regulation Order to enable the enforcement of the electric vehicle charging only parking bays in five neighbourhood shopping centre locations.

 

Reason:

 

The Council have commenced with the installation of EVCPs in the Council’s car parks, the enforcement of the EVCP bays in off-street car parks is already covered by the existing off-street Traffic Regulation Order (TRO), however, there is a need to install new information boards in the car parks that have not previously had EVCPs installed in them.

 

It has also been identified that the parking areas in neighbourhood shopping centres are not covered by the off-street TRO, so enforcement of these spaces is not permitted. Enforcement will only be applicable to vehicles that are not electric that are parked in the EVCP bays, or for electric vehicles that park in the EVCP bays but are not connected up to the charger.

 

There was a need to undertake a statutory consultation to introduce a TRO in these parking areas to enable enforcement of the EV only bays to be legally conducted. A previous Portfolio Holder decision was made as part of this undertaking: Decision - PH-012-2024-To undertake a statutory consultation on the enforcement of Electric Vehicle Charge Point (EVCP) bays in neighbourhood shopping centre locations.

 

The neighbourhood shopping areas that will be covered by the TRO is as follows:

 

·       Leverstock Green – (off-street)

·       Bennetts End – (off-street)

·       Queens Square – (off-street)

·       Bellgate – (off-street)

·       Henry Wells Square – (on-street)

 

The statutory consultation to enforce EVCP bays in neighbourhood shopping centre locations was undertaken on the Council’s corporate consultation platform ‘Lets talk, Dacorum’. The statutory consultation was drafted by the Council’s parking consultants ADL Traffic & Highways Engineering Ltd.

 

The consultation has now concluded and having considered the feedback, Parking Services now recommends continuing to make and implement the Traffic Regulation Order as proposed.

07/03/2025 - PH-005-25 - Business rates - Film studio relief 2024-2034 ref: 2387    Recommendations Approved

This report covers new business rate relief that the Government has announced for ten years, covering the period 1 April 2024 to 31 March 2034.

The Film Studio Relief Scheme will provide eligible film studios with a 40% reduction on their gross business rates during the ten-year period. This reduction is inclusive of any transitional relief which may apply.

As there are a number of national business rates revaluations scheduled to occur during the span of this relief, the Government may change the relief percentage in the future to keep a similar level of benefit for these studios.

As the scheme is designed for a limited period only, the Government is not making changes to legislation, but instead providing detailed guidance, and asking local authorities to use powers under s47 of the Local Government Finance Act 1988 to set up the scheme. Government will then fully repay the cost of relief awarded in line with their guidance.

The government only released the guidance to this policy on the 20th February, hence the need for an urgent portfolio holder decision to ensure that this policy can be implemented as part of the 2025/26 business rates billing process.

This decision adopts the following discretionary business rate relief scheme.

Film Studio Relief Scheme

This is a scheme to cover the period 1 April 2024 to 31 March 2034, for eligible film studios.

Eligibility for the relief will be determined by the Valuation Office Agency (VOA), which is the body responsible for valuing properties for business rate purposes. The VOA will notify the Council of any properties to which the scheme will apply.

There are currently two studios within the borough that we expect to be told will qualify for the relief. They are types of facilities which saw exceptionally large increases at the 2023 revaluation.

The scheme works by fixing a maximum level of business rates which can be charged for any particular day, of 60% of the gross rates calculated based on the rateable value. If the account is also subject to transitional relief following a revaluation, then the level of film studio relief is adjusted to reflect this.

For example, if transitional relief is awarded which is equivalent to 10% of the gross rates, then film studio relief would be awarded for 30%, bringing the total bill to 60% of the gross rates.

If transitional relief is equivalent to 40% or more of the gross rates, then no film studio relief will be awarded.

The detailed guidance for this scheme is published on GOV.UK Business rates: Film studio relief - local authority guidance - GOV.UK, and the scheme adopted by Dacorum Borough Council will follow this guidance, including any future amendments.

For the avoidance of doubt, that means that this scheme allows for the recalculation of any relief amount awarded, including in prior years, where there is any change to the rateable value of the film studio to which the relief has been awarded. The scheme also provides for calculations known as ‘clawback’, which come into operation if there is a change in rateable value from the level that existed when the scheme was designed.

Film Studio Relief is a scheme which is classed as a subsidy under the Subsidy Control Act 2022. This does not impose any cap of the value of relief which can be awarded, but does mean that each individual relief of more than £100,000 is subject to transparency requirements. Such awards will be added to the national subsidy control database on the Manage UK Subsidies Portal.

Our current estimate is that relief for 2024/25 will be approximately £200k, and for 2025/26 it will increase to circa £1m. This expected increase is due to a reduction in transitional relief on the affected accounts.

Authority to make decisions of this type has been delegated to the Portfolio Holder (Corporate and Commercial) by cabinet decision CA/78/17.

04/03/2025 - Submission of the Dacorum Local Plan to 2041 ref: 2386    Recommendations Approved

At the meeting of Full Council on 15 October 2024 the recommendations as set out in the Cabinet referral (from 14 October 2024) were agreed. This included a number of delegated decisions to enable Dacorum Borough Council to submit the Local Plan to 2041 to the Secretary of State. This Officer Decision Record will authorise each of these delegated decisions.

26/02/2025 - Approval to agree a Direct Award to Perki Productions ref: 2383    Recommendations Approved

Perki Productions has provided specialised consultancy support to Hemel Garden Communities and the Local Plan teams over the last 24 months via a Direct Award with DBC.
Ceri Perkins also has a wealth of experience supporting Garden Towns and specialist knowledge to support the engagement process for stewardship policies and strategies; these are required to support the emerging Local Plans for Dacorum and St Albans which recognises community stewardship as a priority.
Ceri will be involved in the drafting and consultation of the emerging Stewardship and Placemaking Supplementary Planning Document which will provide the policy guidance and delivery processes for those bringing forward planning applications within the HGC Growth Areas.
