The Sub-Committee were required to consider an application to review a premises licence for the following premises:

Kitchener’s Field

Castle Hill

Berkhamsted

Hertfordshire

HP4 1HE

Decision

The Sub-Committee accepted the validity of the residents’ concerns, which were supported by past incidents and evidence presented at the hearing. While the Applicant proposed some adjustments to the application, the Sub-Committee was not satisfied that the licensing objectives would be adequately promoted or safeguarded.

In particular:

• The prevention of public nuisance and crime and disorder were at high risk of being undermined, based on previous event-related issues on the site.
• The Applicant did not demonstrate a comprehensive plan to mitigate the foreseeable impacts of regular, large-scale events near a residential area.
• The site’s location, access constraints, and lack of infrastructure for noise and crowd control heightened the Committee's concern.

Accordingly, the Sub-Committee unanimously resolved to refuse the application for a new premises licence.
