A member with a disclosable pecuniary interest or a personal interest in a matter who attends

a meeting of the authority at which the matter is considered -

 

(i)            must disclose the interest at the start of the meeting or when the interest

becomes apparent and, if the interest is a disclosable pecuniary interest, or a personal
interest which is also prejudicial

(ii)           may not participate in any discussion or vote on the matter (and must withdraw

to the public seating area) unless they have been granted a dispensation.

A member who discloses at a meeting a disclosable pecuniary interest which is not registered in the Members’ Register of Interests, or is not the subject of a pending notification, must notify the Monitoring Officer of the interest within 28 days of the disclosure.

 

Disclosable pecuniary interests, personal and prejudicial interests are defined in Part 2 of the Code of Conduct For Members

The Development Management Committee will finish at 10.30pm and any unheard applications will be deferred to the next meeting.

 

There are limits on how much of each meeting can be taken up with people having their say and how long each person can speak for.  The permitted times are specified in the table above and are allocated for each of the following on a 'first come, first served basis':

 

·         Town/Parish Council and Neighbourhood Associations;

·         Objectors to an application;

·         Supporters of the application.

 

Every person must, when invited to do so, address their statement or question to the Chairman of the Committee.

 

Every person must after making a statement or asking a question take their seat to listen to the reply or if they wish join the public for the rest of the meeting or leave the meeting.

The questioner may not ask the same or a similar question within a six month period except for the following circumstances:

 

(a)       deferred planning applications which have foregone a significant or material change since originally being considered

 

(b)       resubmitted planning applications which have foregone a significant or material change

 

(c)       any issues which are resubmitted to Committee in view of further facts or information to be considered.

 

At a meeting of the Development Management Committee, a person, or their representative, may speak on a particular planning application, provided that it is on the agenda to be considered at the meeting.

Councillor Patterson declared that he is the Ward Councillor, and that he is aware of the site, and has come with an open mind.

Councillor Smith-Wright also declared that she has an interest in the item, but has given her apologies for tonight’s meeting so she will take no part in the discussion or voting.

 

The Case Officer, Robert Freeman, introduced the report to Members and said that the application had been referred to the Committee due to the recommendations of Tring Rural Parish Council, and at the request of Councillor Smith-Wright.

 

Councillor Smith-Wright, Mary Davis and Linda Williams spoke in objection to the application.

Laura Bushby spoke in support of the application.

 

It was proposed by Councillor Maddern and seconded by Councillor Durrant to DELEGATE with a view to APPROVAL.

RECOMMENDATION

 

That planning permission be DELEGATED with a view to APPROVAL subject to the completion of a planning obligation under Section 106 of the Town and Country Planning Act 1990 and the following conditions.

That the following Heads of Terms are secured:

-        The provision of 7 units (37%) for affordable housing

-        The provision of off-site and on-site highway works including the provision of a pedestrian crossing and footpath connections between the village and the Grand Union Canal

-        Details of the long-term management and maintenance of public open space including the provision of a habitat management plan

-        The provision of a SAMM contribution of some £17,363.72

RECOMMENDATION

 

That planning permission is GRANTED subject to the following conditions.

Condition(s) and Reason(s):

 

1.              Within 1 months of the approval of this application, a scheme for the landscaping and screening of the substation shall be submitted and approved in writing by the Local Planning Authority. This scheme shall comprise either mature planting or fencing to a minimum height of 2.5m and shall thereafter be completed in accordance within the approved details within a period of 2 months of the discharge of this condition. The approved measures shall thereafter be retained in perpetuity.

Reason: In the interests of visual amenity and residential amenity and in accordance with Policy CS12 of the Core Strategy and Saved Appendix 3 of the Local Plan 1991-2011.

 

2.              Within 3 months of the approval of this application, a noise impact assessment shall be submitted to the Local Planning Authority considering the baseline noise level at the application site and the impact of any noise associated with the use of the substation. If the noise impact assessment identifies an unacceptable level of noise* arising from the substation, the noise impact assessment shall incorporate mitigation measures to reduce the noise to an acceptable level.

Within 1 month of the Local Planning Authority approval of the noise impact assessment (and associated noise mitigation measures, if applicable), any noise mitigation measures shall be implemented in full and thereafter maintained and retained.

In the event that:

a)     no noise impact assessment is submitted within 3 months of the approval of this application;

b)     the noise impact assessment and (and associated noise mitigation measures, if applicable) is not approved within 6 months of the approval of this application; or

c)     any noise mitigation measures required are not implemented within one month of the approval of the noise impact assessment and (and associated noise mitigation measures, if applicable)

the substation shall be turned off so that it is not operational / does not emit any noise until the relevant step (a – c above) has been completed.

The Case Officer, Colin Lecart, introduced the report to Members and said that the application had been referred to the Committee due to the recommendations of Tring Rural. He also referred members to the addendum where the wording of Condition 7 had been amended. He also notified members of a change to the description of the development following the publication of the addendum. 

It was proposed by Councillor Maddern and seconded by Councillor Hobson to GRANT the application.

 4.        The use of the swimming pool hereby permitted shall only take place in accordance with the following restrictions:

             Mondays to Fridays (inclusive)

             Between 09:00am - 22:00pm.

             Saturdays and Sundays and Bank Holidays

             Between 09:00am and 18:00pm.

            Reason:  To enable the local planning authority to maintain control over the use of the site in the interests of the amenity of the locality and protection of the Green Belt; in accordance with Policies CS5 and CS12 of the Core Strategy (2013)

 

 5.        Prior to the first use of the swimming pool building hereby permitted, the parking spaces as shown on the proposed site plan shall be laid out and demarcated for visitors to the site.

            Reason:  To enable the local planning authority to maintain control over the use of the site in the interests of providing sufficient parking and space for servicing in accordance with Policy CS12 of the Core Strategy (2013)
