Declarations of Interest To receive any declarations of interest
A member with a disclosable pecuniary interest or a personal interest in a matter who attends a meeting of the authority at which the matter is considered -
(i) must disclose the interest at the start of the meeting or when the interest
becomes apparent and, if the interest is a
disclosable pecuniary interest, or a personal (ii) may not participate in any discussion or vote on the matter (and must withdraw to the public seating area) unless they have been granted a dispensation. A member who discloses at a meeting a disclosable pecuniary interest which is not registered in the Members’ Register of Interests, or is not the subject of a pending notification, must notify the Monitoring Officer of the interest within 28 days of the disclosure.

The Development Management Committee will finish at 10.30pm and any unheard applications will be deferred to the next meeting.
There are limits on how much of each meeting can be taken up with people having their say and how long each person can speak for. The permitted times are specified in the table above and are allocated for each of the following on a 'first come, first served basis':

Councillor Wyatt-Lowe declared that she was the Ward Councillor and County Councillor for the area and reserved her right to speak and vote.
The Case Officer, Andrew Parish introduced the report to Members and said that the application had been referred to the Committee under s.2.3.2 (4) of Part 3 of the Council’s Constitution as the application is a large-scale major development which is linked to an existing planning obligation under s.106 of the Town and Country Planning Act 1990 (as substituted by s.12 of the Planning and Compensation Act 1991).

The Case Officer, Robert Freeman, and Elspeth Palmer introduced the report to Members and said that the application had been referred to the Committee in the public interest and at the request of Cllr Maddern.
Cllr Maddern declared an interest in the item as she is the Ward Councillor and is speaking against the item. Cllr Maddern took no part in the debate or the vote.
Iain Taylor spoke in support of the application. Parish Councillor Nicola Cobb and Ward Councillor Jan Maddern spoke in objection to the application. It was proposed by Councillor Allen and seconded by Councillor Hobson to REFUSE the application. Vote:

RECOMMENDATION It is recommended that planning permission is REFUSED for the following reasons: 1) The application site is considered to make a strong contribution towards purpose a) in paragraph 143 of the NPPF and as such cannot be considered to comprise “grey belt” land as set out in Annex 2 of the NPPF. It is also not considered to address the requirements of paragraphs 154 and 155 d) of the NPPF and as such must be considered to be inappropriate development in the Green Belt. This inappropriate development, is by definition harmful to the Green Belt and significant harm would also result to the open character and appearance thereto contrary to the NPPF and Policies CS1, CS2, CS5 and CS10 of the Core Strategy. The Very Special Circumstances associated with this case do not out weight the harm identified in relation to the Green Belt and other harm identified in relation to the proposals including the harm resulting from poor design and landscaping. 2) The proposed development, in view of its design, layout, site coverage, scale, height, massing and landscaping is not considered to secure the high design quality and living conditions expected under paragraph 139 of the NPPF and Policies CS8, CS10, CS11, CS12 and CS26 of the Core Strategy, Saved Policies 76 and 106 and Appendices 3 and 6 of the Local Plan 1991-2011, the Car Parking Standards SPD (2020) and Strategic Sites Design Guide SPD (2024). 3) In the absence of a legal agreement, the Council cannot secure affordable housing, highway works and the other necessary infrastructure to make the development acceptable in accordance with the NPPF, Policies CS8, CS9, CS12, CS26 and CS35 of the Core Strategy, Saved Policies 51 and 76 and Appendix 6 of the Local Plan 1991-2011. 4) The Council has not been able to secure appropriate mitigation to address the adverse impact on the integrity of the Chiltern Beechwoods Special Area of Conservation contrary to the Habitat Regulations, Policies CS26 and CS35 of ... view the full minutes text for item 5d Media |
